TERMS & CONDITIONS OF SALE

 

  1. 1.                Offer and Acceptance of Your Order

1.1.           The display of KETO SCIENCE PTE. LTD. (“we”, “our”, or “us”) products (our “Products”) on our website (our “Website”) constitutes an invitation for you to purchase our Products. Your submitting of an order of our Products through the online shopping portal in our Website (our “Online Shop”), and making full payment comprising the price of our Products, less any applicable discount, plus delivery fee (if any) for our Products (the “Charges”), constitutes a binding offer to transact with us. For clarity, we may, after you make an order of our Products through our Online Shop and effect full payment of the Charges, send you a confirmation email; but this confirmation email is intended to inform you that we have received your order and shall not serve as our acceptance at law of your offer to purchase our Products. Our acceptance of your offer to purchase our Products is only constituted when we dispatch our Products to you.

1.2.           You are responsible for checking that your order and payment details are accurate.

1.3.           You must be at least 18 years old to purchase our Products from our Online Shop.

 

  1. 2.                Cancellation of Order

2.1.           We reserve the right to cancel your order if we discover any error, if our Products are not available for any reason, or if we decide at our own discretion that we will not accept your order. No such contract of sale shall be concluded if our Products are not available for dispatch to you. We shall inform you of such cancellation, in which case you will receive a full refund of the Charges paid by you earlier to us.

2.2.           You may cancel your order prior to our dispatch of our Products to you, in which case we will refund you the Charges paid to us. You acknowledge and agree that once we dispatch our Products to you, you may not cancel or amend your order.

 

  1. 3.                Method of Payment

3.1.           You authorise us to collect the sums for your purchase of our Products by the payment method selected by you on our Online Shop. If you are directed to a third party payment processor, you acknowledge that you will be subject to their terms of use of their service. You acknowledge and agree that we are not responsible for any loss or damage arising from your use of such third party payment processors.

3.2.           You shall bear all charges charged by your bank and/or payment processor in relation to the payment of our Products.

3.3.           All Charges are payable in Singapore Dollars, and are inclusive of Goods and Services Tax where applicable. You shall be responsible for paying any applicable taxes, duties and levies arising out of your purchase of our Products.

 

  1. 4.                Delivery

4.1.           We provide delivery services only within Singapore, excluding the following locations:-

(a)              airports and shipping ports;

(b)              army camps, military airbases, naval bases, police stations, civil defence buildings, and other public and government buildings;

(c)              islands outside of the Singapore main island;

(d)              post office box; and

(e)              other places as we may consider from time to time as unsuitable for delivery.

4.2.           We do not accept orders with delivery outside of Singapore.

4.3.           Our delivery fees are as follows:-

(a)              For purchases of our Products with an aggregate value exceeding S$70.00 in a single receipt (after discounts, if any), we will provide free delivery within Singapore.

(b)              For purchases of our Products with an aggregate value of S$70.00 and below in a single receipt (after discounts, if any), we will charge a delivery fee of S$5.00 per delivery within Singapore. The delivery fee must be paid at the time of the payment for our Products.

4.4.           We will use reasonable endeavours to deliver the purchased Products to you within 3 business days from the date of your purchase, but we do not and cannot guarantee that the delivery time frame will be met as there may be circumstances and factors beyond our control which may cause delays in delivery. There will be no delivery services on Sundays and public holidays. We will inform you if our Products are out of stock and/or if we are unable to fulfil your order within the stated time frame.  

4.5.           You acknowledge and agree that we shall not be liable to you for any losses, liabilities, costs, damages, charges or expenses arising out of or in connection with the late delivery of our Products purchased by you.

4.6.           Title to the purchased Products shall pass to you upon delivery of our Products to you. You are responsible to check your order upon delivery of our Products to you. If there is any shortfall or excess in the quantity of our Products ordered, please contact us within 2 business days of the date you received our Products so that we may arrange for the re-delivery and/or return of our Products. 

4.7.           If you fail to accept delivery of the purchased Products for more than 2 attempts, we may charge you a reasonable fee for additional attempts at re-delivering the purchased Products to you.

 

  1. 5.                Return Policy

5.1.           If our Products delivered to you are (i) defective, faulty or expired; or (ii) not in accordance with what you ordered (collectively, “Rejected Products”), we may allow you to return the Rejected Products to us and:-

(a)              allow you to exchange for other Products of equivalent value or higher value (in the latter case, you will need to pay us in full for the difference between the price of the higher value Products and the Rejected Products before returning the Rejected Products to us) (an “Exchange of Rejected Products”); or

(b)              refund the Charges to you using the same method originally used by you to pay us for your purchase of the Rejected Products (a “Refund of Rejected Products”).

Other than the above circumstances, we are not obliged to entertain any request for return of our Products.

5.2.           The Rejected Products must be unused, unconsumed, unopened, unmarked and in original packing condition. You may request for a return of the Rejected Products by emailing us at enquiry@mydrmct.com within 1 week of your receipt of the Rejected Products. We will review your return request on a case by case basis, and we retain the sole discretion to either allow an Exchange of Rejected Products or Refund of Rejected Products, or reject any return of our Products altogether. Your email request shall contain the following:-

(a)              your reason(s) for returning the Rejected Products;

(b)              photographs of the Rejected Products supporting the reason(s) of your return of the Rejected Products;

(c)              copy of the receipt for the Rejected Products in concern; and

(d)              any other relevant information as we may require.

5.3.           Within 1 week of receiving your email request, we will inform you via email whether your request for a return of the Rejected Products is approved or rejected. You must receive our email approval before you may return the Rejected Products.

5.4.           After you receive our email approving your return of our Rejected Products, you must return the Rejected Products by dropping it off at, or sending it to, our logistics support provider (“Fastrans”):-

You shall bear any cost (e.g., courier charges, transport) incurred by you in your return of the Rejected Products to us.

5.5.           After you have dropped off / delivered the Rejected Product in an acceptable condition at Fastrans:-

(a)              if we have approved your request for an Exchange of Rejected Products, Fastrans will facilitate the Exchange of Rejected Products for you handing over or delivering the new Products to you; or

(b)              if we have approved your Refund of Rejected Products, we will, within 3 business days, refund the Charges to you using the same method originally used by you to pay us for your purchase of the Rejected Products.

 

  1. 6.                Limit of Liability

6.1.           We do not warrant, guarantee, or represent (whether express or implied) the fitness, benefits or suitability of our Products in your use of our Products for your purposes.

6.2.           We do not guarantee the availability of our Products as listed on our Online Shop. You acknowledge and agree that our Products are provided on as “as is” and “as available” basis. 

6.3.           You acknowledge that our aggregate liability whether arising out of breach of contract, breach of warranty or any other cause of action shall, to the extent permitted by law, not exceed the Charges we received from you. We acknowledge and agree that we cannot exclude our liability for your personal injury suffered by you arising directly from your use of our Products.

 

  1. 7.                Other Terms

7.1.           We may, from time to time, amend these Terms & Conditions of Sale of our Products by posting on this Website, without any notice. Your access or use of this Website or our Online Shop after any changes have been posted will constitute your agreement to the amended Terms & Conditions of Sale.

7.2.           These Terms & Conditions of Sale of our Products, the relationship between us and the interpretation of these Terms & Conditions of Sale of our Products, shall be governed by, and interpreted in accordance with, Singapore law.
